Terms of Service
By creating an account or using StarBookmark ("the service", "we", "us") at starbookmark.com, you agree to these terms. Please read them carefully.
1. Eligibility
You must be at least 13 years old to use StarBookmark. By using the service, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.
2. Your account
You are responsible for keeping your account credentials secure. Notify us immediately via our contact form if you believe your account has been compromised. You are responsible for all activity that occurs under your account.
Accounts and usernames are personal to you and may not be sold, transferred, or shared with any other person.
3. Acceptable use
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Harass, intimidate, or spam other users through comments, book clubs, or any other feature of the service.
- Upload images that you do not have the right to share.
- Attempt to access, tamper with, or disrupt the service or its servers.
- Use automated means to access the service without our prior written permission.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the service for any unlawful purpose or in violation of any applicable laws.
4. Your content
You retain ownership of content you upload (including shelf photos, comments, and profile information). By uploading content, you grant StarBookmark a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely for the purpose of providing the service.
You are responsible for ensuring you have the right to upload any content you post. We may remove content that violates these terms.
Please ensure your shelf photos do not contain personally identifiable information or private items you would not want shared — such as personal letters, documents, or memorabilia visible in the background. Only photograph the books themselves.
5. Third-party services
StarBookmark uses OpenAI's API to process shelf photos and identify book titles. By uploading a shelf photo, you acknowledge that the image will be transmitted to OpenAI for processing. OpenAI's terms of service and privacy policy apply to this processing.
6. Privacy
Our Privacy Policy describes how we collect and use your data. By using the service, you agree to that policy.
7. Availability and discontinuation
We aim to keep StarBookmark available at all times, but we do not guarantee uninterrupted or error-free access. We may modify, suspend, or permanently discontinue the service, in whole or in part, at any time and at our sole discretion, with or without notice and without liability to you.
If we decide to permanently shut down the service, we will make reasonable efforts to provide advance notice so that you can retrieve any content you wish to keep. We are not obligated to store or provide your data after the service ends.
8. Disclaimer of warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, secure, or that book identification results will be accurate.
9. Limitation of liability
To the fullest extent permitted by law, StarBookmark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.
10. Termination
You may delete your account at any time from your account settings page. We reserve the right to suspend or terminate individual accounts that violate these terms, at our sole discretion and without prior notice.
We also reserve the right to terminate the service entirely at any time, for any reason, without liability. See section 7 for details.
11. Indemnification
You agree to indemnify and hold harmless StarBookmark and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these terms.
12. Severability
If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
13. Changes to these terms
We may update these terms from time to time. We will notify you of material changes by posting a notice in the app. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
14. Governing law
These terms are governed by and construed in accordance with French law. Any dispute arising out of or in connection with these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Rennes, France.
